The government has updated the procedure for arranging deferrals, closing a gap that meant people could lose a valid deferral before they received a new one. This was <a href=\"https:\/\/mod.gov.ua\/\" target=\"_blank\" rel=\"noopener\" title=\"\">reported<\/a> by the Ministry of Defence of Ukraine.<\/p>\n\n\n\n<p>The amendments concern cases where a person already holds a valid deferral but subsequently acquires the right to a different one provided for by Article 23 of the <a href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/3543-12\" target=\"_blank\" rel=\"noopener\" title=\"\">Law of Ukraine &#8220;On Mobilisation Preparation and Mobilisation&#8221;<\/a>.<\/p>\n\n\n\n<p>For example, a person liable for military service holds a deferral as a student, and later a third child is born into their family. This too is a separate lawful ground for deferral. Previously, the procedure did not allow a seamless move from one ground to another, which could lead to legal uncertainty and the risk of losing a valid deferral during re-registration.<\/p>\n\n\n\n<p>The updated procedure is intended to resolve this problem and make it possible to arrange a new deferral without creating such risks.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What the problem was<\/h2>\n\n\n\n<p>The previous mechanism did not ensure that a deferral remained continuously in force while it was being re-registered.<\/p>\n\n\n\n<p>In effect, a person was forced to give up their existing ground in order to arrange a new one. This created a window of time in which information about the new deferral had not yet been entered into the relevant registers, while the previous one had already ceased to apply.<\/p>\n\n\n\n<p>In practice this created a real risk of mobilisation even for people who indisputably had the right to a deferral under the law. The problem lay not in the absence of the right, but in the imperfection of the procedure for exercising it.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What has changed<\/h2>\n\n\n\n<p>The amendments introduced by the government are intended to ensure the continuity of a person&#8217;s legal status while the ground for their deferral changes.<\/p>\n\n\n\n<p>The following rules now apply:<\/p>\n\n\n\n<ul>\n<li><strong>an existing deferral remains in force<\/strong> throughout the entire period during which the commission is considering an application to arrange a deferral on new grounds, provided there are no grounds for cancelling it;<\/li>\n\n\n\n<li><strong>the previous deferral ends only after<\/strong> information about the new deferral has been entered into the Oberih Unified State Register of Conscripts, Persons Liable for Military Service and Reservists;<\/li>\n\n\n\n<li><strong>if the new deferral is refused<\/strong>, the previous deferral remains in force until the end of the period for which it was granted.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Why these changes matter<\/h2>\n\n\n\n<p>The new procedure effectively removes the situation in which a person liable for military service could lose valid legal protection simply because they wished to arrange a different, more relevant ground for deferral.<\/p>\n\n\n\n<p>In other words, the changes uphold the principle of legal certainty: until the competent authority takes a decision and enters the relevant information into the register, the person is not left without a valid deferral.<\/p>\n\n\n\n<p>This should also help reduce the number of disputes connected with the unlawful mobilisation of people who in fact had the right to a deferral but were in the process of re-registering it.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What to bear in mind<\/h2>\n\n\n\n<p>Despite these positive changes, the new procedure does not mean a deferral will be granted automatically on different grounds. The commission will, as before, verify that all the grounds provided for by law are present and that the documents submitted are in order.<\/p>\n\n\n\n<p>Persons liable for military service should therefore check in advance whether their documents meet the requirements of the legislation, and whether the new ground genuinely falls within the list set out in Article 23 of the Law of Ukraine &#8220;On Mobilisation Preparation and Mobilisation&#8221;.<\/p>\n\n\n\n<p>From a practical point of view, these changes strengthen the legal protection of persons liable for military service and close one of the most significant procedural gaps that arose during the re-registration of a deferral.<\/p>\n\n\n\n<p><em><strong>This material was produced with the support of the international charitable platform GlobalGiving and the Charles Stewart Mott Foundation.
