It can help to survive now, in a situation of full-scale war in Ukraine, to recover and develop after its completion. However, this may be hampered by increased threats to land security through the decline of government, violence, demographic change, land grabbing, destruction of housing and infrastructure, and so on.<\/strong><\/p>\n\n\n\n<p>To learn more about these and other risks, the Legal Development Network in collaboration with the <a href=\"https:\/\/www.worldbank.org\/en\/home\" target=\"_blank\" aria-label=\" (opens in a new tab)\" rel=\"noreferrer noopener\">World Bank<\/a> has initiated the creation of a framework for tracking risks to land tenure security in Ukraine.<\/p>\n\n\n\n<div class=\"wp-block-image is-style-circle-mask\"><figure class=\"alignleft size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/ldn.org.ua\/wp-content\/uploads\/2022\/06\/IMG_7488-3.jpg\" alt=\"\" class=\"wp-image-14360\" width=\"268\" height=\"294\" srcset=\"https:\/\/ldn.org.ua\/wp-content\/uploads\/2022\/06\/IMG_7488-3.jpg 555w, https:\/\/ldn.org.ua\/wp-content\/uploads\/2022\/06\/IMG_7488-3-273x300.jpg 273w, https:\/\/ldn.org.ua\/wp-content\/uploads\/2022\/06\/IMG_7488-3-182x200.jpg 182w\" sizes=\"(max-width: 268px) 100vw, 268px\" \/><figcaption><em> \u0441ocoordinator of the project expert group <strong>Oleksii Shamov<\/strong> <\/em><\/figcaption><\/figure><\/div>\n\n\n\n<p><em>\u2018What is happening now with the security of land use in Ukraine? What\nare the risks of land use? How can they be reduced in the postwar period? We\nwill try to find the answer to all these questions in our study, which will\nlast from June to July 2022 and will cover the entire territory of Ukraine<\/em><em>.\u2019<\/em> says the\nco-coordinator of the project expert group <strong>Oleksii\nShamov.<\/strong><\/p>\n\n\n\n<p>Experts from the Legal Development Network\nwill analyze the legislation and study how it affects land use and security.\nThey will collect administrative data of responsible institutions and\norganizations to find out the situation in certain regions and territorial\ncommunities of Ukraine. Not only databases (registers, media, online government\noffices, requests for information) will be useful, but also the experience of\nlawyers and interviews with local government representatives. <\/p>\n\n\n\n<div class=\"wp-block-image is-style-circle-mask\"><figure class=\"alignleft size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/ldn.org.ua\/wp-content\/uploads\/2022\/06\/IMG_8655_750x500_acf_cropped-1.jpg\" alt=\"\" class=\"wp-image-14358\" width=\"259\" height=\"290\" srcset=\"https:\/\/ldn.org.ua\/wp-content\/uploads\/2022\/06\/IMG_8655_750x500_acf_cropped-1.jpg 446w, https:\/\/ldn.org.ua\/wp-content\/uploads\/2022\/06\/IMG_8655_750x500_acf_cropped-1-268x300.jpg 268w, https:\/\/ldn.org.ua\/wp-content\/uploads\/2022\/06\/IMG_8655_750x500_acf_cropped-1-178x200.jpg 178w\" sizes=\"(max-width: 259px) 100vw, 259px\" \/><figcaption><em> <strong>Liudmyla Hrytsenko<\/strong>, co-coordinator of the project expert group <\/em><\/figcaption><\/figure><\/div>\n\n\n\n<p><em>\u2018We need to know not only the law but also how it works, so to speak,\nthe objective reality that exists on the ground. After all, before the war<\/em><em>, we observed different\ncase <\/em><em>laws, different interpretations and perceptions of both legislative\ninstruments and the consequences of their implementation, and today, during a\nfull-scale war, administrative data have become even more important because\ndifferent areas are in different conditions<\/em><em>.\u2019,<\/em> <strong>Liudmyla Hrytsenko<\/strong>,\nco-coordinator of the project expert group, notes<strong>.<\/strong><\/p>\n\n\n\n<p>Policy and legislation may no longer reflect\nreality, such as mass displacement and the resurgence of historical\nland grievances and emergence of new ones. Legal and regulatory frameworks may remain\nunimplemented or used by state and non-state actors as a tool to disenfranchise\ncertain groups. The inability to maintain land registries and cadasters means land records\ncan become inaccurate and a\nsource\nfor new conflicts. Land records may also be destroyed,\nthrowing land rights into chaos. Government can quickly lose control of\npublic lands, and vulnerable persons become victims of forced evictions through sales of land\noccur under duress or coercion. Those with financial resources or political\nconnections may exploit market distortions to their favor. These factors shape the core\nelements of land markets, creating conflict land markets that in turn threaten tenure security.<\/p>\n\n\n\n<p>The study has already begun. In doing so,\nexperts aim to understand how war affects land security, identify opportunities\nto mitigate identified risks and help plan a postwar land management system\nthat strengthens land security.<\/p>\n\n\n\n<p><em>The implementation of the project\n&#8220;Tool for comprehensive monitoring of security risks of land tenure in\nUkraine&#8221; is supported by the World Bank under the #StandWithUkraine\nProgram, coordinated by the Legal Development Network.<\/em><\/p>\n\n\n\n<p><em>The World Bank, a credit and financial\ninstitution founded in 1945, is one of the largest in the world providing\ndevelopment assistance.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Written by: Halyna Kolesnyk, the Communications Manager of the Legal Development Network Land is an important economic resource for Ukraine.
