She\u00a0tried to obtain\u00a0a power of attorney without their mother&#8217;s permission but in vain. <strong>Vyacheslav Lyakh<\/strong>, lawyer at the <em>Bilozersky Office of the Legal Development\u00a0Network<\/em>, explained the rules of legislation that regulate\u00a0the crossing of the border by the\u00a016-year-old Ukrainians.<\/p>\n<p><img decoding=\"async\" src=\"http:\/\/storage.ldn.org.ua\/source\/1\/a87362e2e7978e668f597a0079f94f98_M.jpg\" \/><\/p>\n<\/div>\n<div>\n<p><em>Lawyer of Belozersky Office of the Legal Development Network Vyacheslav Lyakh<\/em><\/p>\n<p>&nbsp;<\/p>\n<p><strong>Kateryna Donets<\/strong>* turned to <em>Bilozersky Center for Regional Development<\/em>. According to the <em>IRC &#8220;Legal space,&#8221;<\/em> the 27-year-old girl lives with her minor brother, who is already 16 years old. Their mother lives in Russia, and\u00a0their\u00a0father\u00a0is missing.<\/p>\n<p>The siblings were planning\u00a0to visit their\u00a0mother\u00a0but since the boy is a minor, <strong>Kateryna<\/strong> decided that a notarized power of attorney was required for her brother to travel abroad. The notary informed <strong>Kateryna<\/strong>\u00a0that he could\u00a0not issue a power of attorney without their\u00a0mother. To do this, she needs to apply to the court with a petition for granting a permit for a minor to travel abroad without one of the parents\u2019 consent.<\/p>\n<p>Having studied\u00a0the current legislation, the lawyer of the Office said that, according to Art. 2 of the Law &#8220;On the procedure for departure from Ukraine and entry into Ukraine of citizens of Ukraine&#8221;, minor citizens of Ukraine leave Ukraine with a passport of a citizen of Ukraine for travelling abroad, issued to children under the age of 18.<\/p>\n<p>Also, in part 3 of Article 313 of the Civil Code of Ukraine, an individual who has reached\u00a0the age of sixteen has the right to free independent travel outside of Ukraine.<\/p>\n<blockquote><p><em>&#8211; To date, in order to cross the border with Russia you only need to have\u00a0a passport of a citizen of Ukraine, &#8211; the lawyer commented. &#8211; So, <strong>Kateryna<\/strong> does not need any\u00a0additional documents for travelling abroad with her brother.<\/em><\/p><\/blockquote>\n<p>According to the lawyer, the notary should have informed <strong>Kateryna<\/strong> about this, but for some reason he sent her to court.<\/p>\n<blockquote><p><em>&#8211; The notary knew that the boy was already 16 years old. But he refused to issue a power of attorney to cross the border of a minor without the consent of his\u00a0mother. Although, in my opinion, he\u00a0had to inform that such a power of attorney is not needed in this case.<\/em><\/p><\/blockquote>\n<p><strong>Vyacheslav Lyakh<\/strong> emphasized\u00a0that in order to travel to the counties of the\u00a0EU it is required\u00a0to have a biometric children&#8217;s passport:<\/p>\n<blockquote><p><em>&#8211; You should keep in mind that in order for a minor to travel to the EU countries, the only official document that allows a child with Ukrainian citizenship to cross the border is a biometric children&#8217;s passport.<\/em><\/p><\/blockquote>\n<p>&nbsp;<\/p>\n<p>* The name has been changed for ethical reasons.<\/p>\n<p><em>Written by Alexander Yermolayev, &#8220;Legal Space&#8221;<\/em><\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Sister and brother decided to go visit their\u00a0mother in\u00a0Russia, but the girl did not know which requirements have to be met so that her\u00a0minor 16-year-old brother could go abroad.
